Terms of registration with the network.free-economy.gr website

1) Registered members are exclusively responsible for their published material.
2) Sole responsibility for the bilateral transactions lies with the two parties involved in each transaction. The website is operated only on an informative basis.
3) The website owner reserves the right to deny posting of submitted material (advertise-ments) for publication if deemed of improper content. (In such an event fees are refunded).
4) Members registered with the website are entitled to request withdrawal of their adver-tisement before its expiry date. Note that in such an event no refund of fees is possible for the remaining period.

If interested in bilateral transactions only and not interested in registering with the Free Economy Alternative Exchange Network, you don’t need to read through the following.

If you however intend to register with the Free Economy Alternative Exchange Network (in order to be able to have transactions in “enallaktika”) you ought to study and accept the following rules of procedure.

Rules of Procedure for the Free Economy Alternative Exchange Network

A) MEMBERS

A1) Members of the Free Economy Alternative Exchange Network are distinguished in assistant, probational and full members. All three types of members are entitled to trans-actions using the virtual “currency” of the Alternative Exchange Network called “enallaktiko” (“alternative”) which has an exchange rate value of:

1 “enallaktiko”= 1 EURO

The “enallaktiko” is called a “currency” only by convention. In fact it is a measurement unit for the purpose of evaluating services and goods.

 

Β) CREDIT LIMIT / TRANSACTIONS:

Β1) Every full and every probational member of the Free Economy Alternative Exchange Network is entitled to credit. This means that he/she can request more services than the services he/she has offered, and that he/she at the same time undertakes to offer his/her services of equal value in the future. The right in credit is limited (credit limit). The limit is 250 “enallaktika” +25% of the “offering factor” for each member (the highest credit limit being 2,000 “enallaktika”). The offering factor is explained further on, at the end of paragraph B.

All assistant members of the Free Economy Alternative Exchange Network are not enti-tled to a credit account.

Β2) The credit limit of any member may not exceed 2,000 “enallaktika”.

Β3) If any member wishes to enter into a transaction of an amount higher than his/her al-lowed credit limit, he/she may complement his/her payment in Euros. Also, every member paid in “enallaktika” reserves the right to request payment in Euros or other means as part of their fee.

Β4) Members may add “enallaktika” to their account by paying the appropriate amount in Euros at the treasury of the Free Economy Alternative Exchange Network. This procedure is called “account backing” and is necessary if a member is facing deregistration and wishes to cover his/her liabilities (refer to Articles E and G).

Definition of the ‘offering factor’:

- The offering factor is the turnover of work in “enallaktika” offered by each member to other members of the Free Economy Alternative Exchange Network, with the following exceptions:
1) Work offered by a member to another member sharing the status of “a first degree guarantor” is not included in the offering factor.
This means that:
1a) Work offered by a member to members who have been granted his/her guarantees is not counted in the offering factor.
1b) Work offered by a member to members who have granted their guarantees to this member is not counted in the offering factor.
1c) Work exchanged between members sharing a common guarantor is not counted in the offering factor.
(The above does not mean that members sharing the status of “a first degree guarantor” may not exchange services or pay each other. The offering factor (which affects the credit limit) is simply not increased by such transactions).
2) Maximum increase in the offering factor from transactions with any particular member may not exceed 800.
I.e. even if a 1,000-or 2,000-unit transaction takes place with a particular member, the offering factor will only be increased by 800 (thus his/her credit limit shall only be increased by 800:0,25=200 “enallaktika”).
3) If 2 members have a transaction bidirectionally (i.e. member A offers work to member B and then member B offers work to member A) only the “direction” of the first transac-tion counts in the offering factor.

 

C) NEW MEMBERS / MEMBER UPGRADE

C1) Member registration with the Free Economy Alternative Exchange Network: Possible to any natural person, a legal resident of Greece aged 18 and above, or any legal person eligible to fill the appropriate membership application form in a physical format, which will then need to be submitted to an authorised representative of the Free Economy Alter-native Exchange Network
A registration fee of 20 Euros applies for probational members who are thus credited 20 “enallaktika” in their account (and are also granted a credit limit of 250 “enallaktika”).

Assistant members have two choices:

a) They may pay a registration fee of 20 Euros are thus credited 20 “enallaktika” in their account (but granted a zero credit limit).

b) They may pay a registration fee in “enallaktika” as soon as they are paid an efficient amount of “enallaktika” by another member. (Note that they are credited 20 “enallaktika” in their account from the begining so that they can pay for the publishing of their service or product in the site – since they have zero credit limit). This payment must be made prior to them paying any other members.

New members shall fill an application form with their details.
C2) Membership as an assistant member is possible for any legal resident of Greece or any legal person who wishes to register.
C3) Membership as a probational member is possible for any legal resident of Greece or any legal person wishing to register, provided two full members are found to guarantee for his/her/its membership. An assistant member may, after registration, become a proba-tional member provided two full members accept to guarantee for his/her/its member-ship.
C4) Any probational member may become a full member after achieving an “offering factor” of at least 1,000.
C5) “Start” members are a special type of full members, in that they are an exception to rule C4. They automatically become full members upon their registration even though they have not yet gained an offering factor of 1,000 “enallaktika”. The registration fee for start members amounts to 20 Euros.
For a member to become a start member the following shall apply:
1) An invitation for a start membership shall have been issued by one of the partners of the Alternative Network, who signs the registration application form for the start member.
2) Two other start members and/or full members shall act as guarantors.
The partners of the Alternative Network can assign start membership to an assistant member upon registration. This is possible if they judge that the start member has proved to be a credible member.

 

D) NEW MEMBER GUARANTORS

D1) Guarantors shall be held liable if any member of the Free Economy Alternative Ex-change Network for whom they had provided guarantees is deregistered without settling his/her payments. In the event of such deregistration, the amount owed by the deregis-tered member is transferred as a debit entry to the accounts of the ex-member’s two guar-antors (by one half to each guarantor).
D2) A full member of the Free Economy Alternative Exchange Network may not act as a guarantor for more than 8 persons.

E) SETTLEMENT OF PAYMENTS / MEMBER DEREGISTRATION:

Ε1) If both of the following conditions apply to any member at the same time:
1) The member owes more than 20% of his/her credit limit, throughout the last year (i.e. during the last 365 days)
2) The amount owed exceeds the increase in the member’s offering factor throughout the last year (i.e. during the last 365 days),
the result will be:
Account lock regarding the member’s capability to make payments to other members. This means that the member will only be able to receive payments from other members, but will not be able to make payments before he/she achieves a positive balance. Such member shall have to achieve a positive balance in his/her account before the expiry of two extra years (730 days). This is possible via payments in “enallaktika” to be received from other members of the Free Economy Alternative Exchange Network during these two years. In case the member has not settled in full the amount owed within this time frame either through his/her services or his/her goods, the member shall have to pay such amount (in Euros) at the treasury of the Free Economy Alternative Exchange Network (concerning his/her costs of administration/bureaucracy) through the procedure of account backing described in article G.5.e
(Put otherwise, if the third year also expires without the member managing to settle the amount due through his/her services, he/she shall have to pay in Euros the service he/she received before 3 years, i.e. he/she shall pay for it after 3 years and indeed interest-free. Moreover, on the very next day, having been credited his/her “enallaktika”, the member shall be able to spend the amount paid within the network (in effect, no money is actually lost). This is possible because his/her balance shall be matched and he/she shall be again able to request goods and services from network members).
If the member refuses to pay this amount, the Free Economy Alternative Exchange Net-work shall deregister the member.
Ε2) Deregistration of a member is also imposed after the conoccurrence of the following:
1) If at least 5 full members justifiably request the member’s deregistration on the grounds of problems caused to the Free Economy Alternative Exchange Network by the member.
2) If the charge against the member is not contradicted by more full members than the accusing full members.
E3) Intended deregistration of a Free Economy Alternative Exchange Network member is possible after a written request of the member which is submitted to a partner of the “Al-ternative Network” or to an authorised representative of the Free Economy Alternative Exchange Network. If the account of the member requesting deregistration shows a credit balance, the member shall have to cover his/her sum due via work offered or in Euros. In case the member deregisters without prior settlement of his/her amount due, such an amount is transferred in half to the accounts of each of his/her guarantors. In case the member deregisters and his/her account shows a positive balance in “enallaktika”, this amount is transferred to the account of “bureaucracy_support_payments” which covers the costs of administration/bureaucracy for the Free Economy Alternative Exchange Net-work
Ε4) A deregistered member that failed to cover his/her liabilities is not eligible for new registration in the future. The member’s identity is also published in the website.
A deregistered member that has covered his/her liabilities is eligible for a return registra-tion. However, the partners of the Alternative Network reserve the right to impose further conditions upon his/her new registration if they deem it necessary.

F) REPAYMENT OF CONTRIBUTORS TO the Free Economy Alternative Exchange Network

The community of members belonging to the Free Economy Alternative Exchange Net-work will offer their services and/or goods in return for work provided by people who contribute to the operation of the Free Economy Alternative Exchange Network. More specifically:
- There is an account under the username of “site_support”, with an initial capital of 4,000 “enallaktika” intended for the compensation of people who have either worked or shall work in the future for the software’s creation, upgrade and improvement for the Free Economy Alternative Exchange Network. Compensation from this account cannot be paid to the website owner. Such compensation is only possible to freelance providers who assist in the website’s development and operation.
- There is also an account under the username of “bureaucracy_support”, with an initial capital of 8,000 “enallaktika”, intended for the compensation of people who work after 31/3/2012 for the costs of administration/bureaucracy of the Free Economy Alternative Exchange Network.
These amounts represent the services and/or goods paid to the contributors in exchange for the work contributed in these fields. Payment via these two accounts is not possible to the benefit of any partner of the Alternative Network. Payment from these two accounts is only possible after the unanimous decision of the General Assembly of the Alternative Network or, in the event of failure to reach unanimity, after approval from the absolute majority of the General Assembly. When the aforementioned resources are exhausted, funding of the aforementioned purposes will be drawn from the revenues coming from:
a) fees charged on the members of the Free Economy Alternative Exchange Network (in-cluding a 12-enallaktika fee paid once for the posting of a new service or good and a 2% rate on the transactions in enallaktika); and
b) the account-backing payments described further on:
- In January of each year 500 “enallaktika” will be deposited to the “site_support” account and 1,000 “enallaktika” to the “site_admin_payments” account through the username of “enisxysi_logariasmou”.
- In January of each year (starting from January 2014) 6xN “enallaktika” will be deposited to the “site_admin_payments” account through the username of “enisx-ysi_logariasmou”, N being the number of posted advertisements.
- In January of each year 3,500 “enallaktika” will be deposited to the “bureaucra-cy_support” and “bureaucracy_support_payments” accounts through the username of “enisxysi_logariasmou”.
(After questions on this subject, let it clarified at this point that: No member of the Free Economy Alternative Exchange Network shall be burdened with work without receiving payment. None of the members is charged by these accounts. On the contrary, they assist in the increase of liquidity within the community: As said, those who contribute to the operation of the Free Economy Alternative Exchange Network shall be paid from the aforementioned accounts. When members afterwards offer their services to the contributors, they are paid in “enallaktika” by the contributors. Then these “enallaktika” can be spend within the network and so on and so forth. The idea was taken from Michael Unterguggenberger, the Austrian Mayor of Worgl who had used a similar method to put some municipal works into practice and relieve his city’s economy).

G) ADDITIONAL TERMS FOR MEMBER REGISTRATION WITH the Free Economy Alternative Exchange Network

    1. The partners of the non-profit civil law partnership of “Alternative Net-work” reserve the right to propose to the full members of the Free Econ-omy Alternative Exchange Network amendments to the rules of procedure of the Free Economy Alternative Exchange Network, in all forms, by add-ing new rules or repealing existing ones. All proposed amendments shall be posted in the network.free-economy.gr website. Full members of the Free Economy Alternative Exchange Network shall approve or disapprove of these amendments after public (for the full members) and open internet vote which starts at the time the voting is announced and ends 120 hours (i.e. 5 twenty-four-hour periods) after the proposal was submitted. Full members shall be informed about the starting of the vote in their e-mails (used to register with the network.free-economy.gr website). An amendment is approved if voted by at least 50% of the voting full members. Voting results are valid regardless of the participation rates of the full members who voted.
    2.  Α) Membership and any other acquired privileges are not transferred or as-signed for any reason whatsoever and in any way.
      Β) Members are obliged to inform of possible changes in their details pro-vided with their original application, either by sending an e-mail message to admin@free-economy.gr or in writing to an authorized representative of the network.
    3.  The responsibility for transactions based on a bilateral agreement or in “enallaktika” lies exclusively with the parties involved. This means that the network.free-economy.gr website provides only informational material and an opportunity for recording transactions. In that context:
      A) The Free Economy Alternative Exchange Network and the owner of network.free-economy.gr website can not be held responsible for those who state to any network member that they intend to pay the member in “enal-laktika” (or that they intend to provide services or goods) but finally fail to do so.
      B) Eventual transactions performed as a result of such informational material and of the function of recording transactions are concluded outside of this website and the Free Economy Alternative Exchange Network. Users and members ought to demonstrate necessary caution, comply with legal provisions (especially those related to Consumer Protection and Personal Information) and issue all legal documents.
    4. The Free Economy Alternative Exchange Network and the administrators of the website serving it will strive to take every particularly sensible preventive action to avert any damages to the website. Every humanly possible effort will also be undertaken for the restoration of the website in case of damage or destruction. The Free Economy Alternative Exchange Network and the administrators of the website however are not responsible or undertake any liability whatsoever against any member for any damage resulting, in whole or in part, directly or indirectly, from the operation of the network.free-economy.gr website and/or its eventual dissolution.
    5. Payment of the owner of the website hosting the electronic network of ser-vices exchange and serving the Free Economy Alternative Exchange Net-work (by performing the transactions with no money return) is covered by contributions of the members of the Free Economy Alternative Exchange Network to the owner, without the financial mediation of the non-profit civil law partnership named “Alternative Network”. The assignment of the administration of said website is done after the unanimous decision of the General Assembly of the Alternative Network or, in the event of failure to reach unanimity, after approval from the absolute majority of the General Assembly.
    6. The network.free-economy.gr website includes six usernames – members of the Free Economy Alternative Exchange Network which do not correspond to any natural or legal entities:
      a) The “site_support” which is discussed in article F.
      b) The “bureaucracy_support” which is also discussed in article F.
      c) The “site_admin_payments” whose administration is in the hands of the administrator-in-office of the network.free-economy.gr website. The administrator must also have a personal username with which he/she has registered with the website and makes transactions with other members of the Free Economy Alternative Exchange Network (for services provided beyond the operation of the network.free-economy.gr website). Through the “site_admin_payments” account the administrator shall draw his/her payment for the administration of the network.free-economy.gr website (by transferring “enallaktika” to his/her personal account), but he/she may be able to pay freelance providers for their work in the website. The reason there is an independent account called “site_admin_payments” is the fact that the website administrator may not always be the same person. (In the table of users’ transactions “site_admin_payments” is displayed as “free-economy.gr”).
      d) The “bureaucracy_support_payments” which belongs to the person-in-office responsible for the administration and bureaucracy works of the Free Economy Alternative Exchange Network. Such person is appointed by the partners of the “Alternative Network” and he/she shall also have a personal username for transactions with the other members of the Free Economy Alternative Exchange Network (for services provided beyond the administration and bureaucracy works of the Free Economy Alternative Exchange Network). Through the “bureaucracy_support_payments” account the person-in-office responsible for the administration and bureaucracy works of the Free Economy Alternative Exchange Network shall draw his/her payment for his/her services to the Free Economy Alternative Exchange Network (by transferring “enallaktika” to his/her personal account), but he/she may also be able to pay freelance providers for their services to the Free Economy Alternative Exchange Network. The reason there is an independent account called “bureaucracy_support_payments” is the fact that the person-in-office for the administration and bureaucracy works of the Free Economy Alternative Exchange Network may not always be the same person. (In the table of users’ transactions “bureaucracy_support_payments” is displayed as “Έξοδα δικτύου” [‘Network costs’]).
      e) The “enisxysi_logariasmou”. This is the only username which can re-ceive deposits in “enallaktika” in its account (after its initial creation) since “enallaktika” are added only, without being taken away from any other account. This username exists solely for the purpose of account backing as specified in Articles Β4 and F. The deposit of “enallaktika” in this account is possible in the following cases: 1) When a member pays an amount in Euros (at the treasury of the Free Economy Alternative Exchange Network) in order to back his/her account. After being deposited in the account of the username “enisxysi_logariasmou”, this amount is transferred as a payment entry in “enallaktika” from the “enisxysi_logariasmou” username to the paying member’s username. 2) For the purpose of supporting the accounts of “site_support”, “site_admin_payments”, “bureaucracy_support” and “bu-reaucracy_support_payments” described in Article F.
      f) The “volunteers” username which may be used by members of the Free Economy Alternative Exchange Network to make donations to the voluntary section of the Alternative Network. Payment from the “volunteers” username to a partner of the Alternative Network is not possible. Payments drawn from the “volunteers” account are only possible after the unanimous decision of the General Assembly of the Alternative Network or, in the event of failure to reach unanimity, after approval from the absolute majority of the General Assembly.
      Other than these 6 exceptions, each and every username of the Free Econ-omy Alternative Exchange Network shall correspond to a natural or legal person, and no natural or legal person is entitled to own more than one username.
      For reasons of reliability, the income and expenditure items of the accounts “site_support”, “bureaucracy_support”, “site_admin_payments”, “bureaucracy_support_payments”, “enisxysi_logariasmou” and “volouteers” are at the disposal of any member of the Free Economy Alternative Exchange Network requesting to check them.
    7. For the securement of credibility of the Free Economy Alternative Exchange Net-work, an audit is performed on March each year by a tripartite committee which is informed of all the transactions completed within the Free Economy Alternative Exchange Network in order to check the accounts for any irregularities. The tripartite committee is elected by the full members of the Free Economy Alternative Exchange Network after public (for the full members) and open internet vote which takes place on 3rd March every year. The full members of the Free Economy Alternative Exchange Network shall be informed about the voting (and about their potential candidacy) on 1st March at their e-mail address (used to register). Any full member of the Free Economy Alternative Exchange Network can be a candidate for this committee on 1/3 or 2/3 every year by sending a 500-word resume and a photograph to admin@free-economy.gr. Each member of the tripartite committee shall be paid a fee of 50 “enallaktika” for the services offered to the community of the Free Economy Alternative Exchange Network. The website administrator shall also be paid 50 “enallaktika” for the organization of the voting and the work with the audit committee. Note here that the election of the audit committee is valid regardless of the participation rates of the full members who voted.
      Beyond the annual audit, any member (assistant, probational or full) or any group of members (assistant, probational or full) of the Free Economy Alternative Ex-change Network are at any time entitled to request an audit in writing. Such mem-bers must cover the audit expenses (200 “enallaktika” in total). If, for example, five members file the request, they need to pay 40 “enallaktika” each to the “bureaucracy_support_payments” account (which deals with the costs of administration/bureaucracy works of the Free Economy Alternative Exchange Network), on the same day they submit their request. Announcement of the audit request shall be made on the next day following the request submission via an e-mail message sent to all of the full members. A 2-day period shall follow for candidacies for the tripartite audit committee and the voting shall take place on the third day.
      Results of such audits shall be posted in the network.free-economy.gr website.
      The tripartite committee shall respect the privacy of transactions and shall not be entitled to make any transaction public to third parties. In case any transaction is disclosed to any third party by a member of the audit committee, the disclosing member is permanently deregistered from the Free Economy Alternative Exchange Network (in addition to legal consequences). If such member is deregistered having a positive balance in “enallaktika” in his/her account, this amount is transferred to the “bureaucracy_support_payments” which covers the costs of administration/bureaucracy works of the Free Economy Alternative Exchange Network. In the opposite case the sum owed by the deregistered member is transferred as a debit entry to the accounts of the ex-member’s two guarantors (by one half to each guarantor).
      The above assumes that the members of the Free Economy Alternative Exchange Network grant the website administrators the authorization to provide the necessary information for their auditing to the tripartite committee.
    8. Policy on Protection of Personal Information. Handling and protection of personal information is governed by the provisions of applicable legislation, law 138(i) of the year 2001 regarding the protection of personal information, as well as the cur-rent rules.
      According to the provisions of the aforementioned Law, the Alternative Network, being responsible for the processing of data in the context of the Law, informs that for a member to register with the Free Economy Alternative Exchange Network and to be able to make transactions, collection and processing of personal data is required.
      The data is recorded in electronic or other formats, in one or more files of personal data in the context of the Law, which shall be kept by the Alternative Network or other subcontracted/co-operating persons.
      Data recipients are the competent staff members of the company as well staff members of the subcontracted/co-operating persons (including the members of the tripartite committee for the auditing of the transaction system credibility stipulated in paragraph F7). Data processing is confidential and is only performed by persons controlled by the person in charge of data processing.
      Any member is entitled to access and correct the personal data related to him/her.
      All terms and conditions are applicable and interpreted according to the laws of Greece in force. The Courts of Athens shall be responsible to resolve any disputes.
    9. In the event of death for a natural person who is a member of the Free Economy Alternative Exchange Network:
      - If a positive balance appears in the member’s account, this amount is transferred to cover the costs of network administration (i.e. to the “bureauc-racy_support_payments” account)
      - If the balance is negative, it is cancelled. However, the “enallaktika” used by the member to pay other members who had offered their services to him/her remain valid.
      In case a legal entity that is a member of the Free Economy Alternative Exchange Network closes down:
      - If there is a positive balance this amount is transferred to cover the costs of net-work administration (i.e. to the “bureaucracy_support_payments” account)
      - If the balance is negative, the sum due is divided to the guarantors (provided they are alive and not deregistered natural persons or not closed down or deregistered legal entities), as in the case of deregistration. If none of the above applies, the sum due is cancelled.
      - If any member of the Free Economy Alternative Exchange Network is deregis-tered while owing to the network and his/her guarantor has deceased/deregistered, the respective sum due is cancelled. However, the “enallaktika” used by such member to make payments are valid.
    10. Participation in the Free Economy Alternative Exchange Network is on condition of an unreserved acceptance of all of the above terms and conditions.
